Hery Frédéric Ranjeva is a partner in Foley Hoag's Paris office. Hery Frédéric concentrates his practice on international law, international litigation and arbitration matters, and frequently represents sovereign states, companies and individuals before French and Malagasy national courts and tribunals. He has experience assisting with all aspects of institutional (ICC, ICSID, LCIA) and ad hoc commercial arbitrations, from commencement through enforcement. He counsels foreign investors operating in Madagascar. Hery Frédéric also acted as counsel and advocate to a sovereign state in an International Court of Justice (ICJ) case.

REPRESENTATIVE EXPERIENCE:

  • Advocate and counsel of the Republic of Senegal in an International Court of Justice case concerning questions relating to the Obligation to Prosecute or Extradite (Belgium v. Senegal)

  • Represented a South American Republic in a USD 515 million ICSID claim brought against it under a bilateral investment treaty

  • Represented a company from the United States in its efforts to enforce a USD 125 million favorable ICSID award against a sovereign state

  • Represented the French subsidiary of a Norwegian company, claimant in an ICC arbitration relating to the construction of oil platforms

  • Represents a European oil company, claimant in a ICC arbitration against an African State, regarding the exploitation of an oil field

  • Represented a Western European tourism company, respondent in an ICC arbitration relating to a resort village located in the Indian Ocean

  • Advised a Western European tourism company in its ad hoc, ICC and LCIA arbitrations relating to hotels located in the West Indies, Nigeria, Morocco and Congo

  • Represented a Western European leasing company, defendant in an annulment proceeding filed against an ICC arbitral award against French court

  • Represented Spanish, Swiss and Tunisian banks before French courts in banking liability-related matters

  • Represented sovereign states before French courts in labor and real estate matters

  • Represents Malagasy groups (commodities traders) in their disputes against buyers, brought before French and international arbitration courts

  • Counsels the operator of one of the largest mining projects in the Southern Hemisphere on general legal and tax issues; representation of the same before local courts and authorities
  • Assists a Western European company (tourism) on legal issues in its investment on a resort-village in Madagascar; representation of the same company before Malagasy courts and an ICC arbitral tribunal

  • Represented two foreigners falsely accused of aggravated murder before a Malagasy criminal court
